Overview

The public Works Contract was published on 19th February 2007 for use on all public works.  This constitutes a large section of the construction market and this new contract involves a step change in approach.

 

This course addresses the completely different drafting of the four main contracts in the construction phase of the work.  Obligations, risks and administration will be centre to the course.  Case studies are used to illustrate contract interpretation.

 

This is a practical course which emphasises those areas that give most problems to the contract administrator - additional payments, time programme and delay.

  • Contract Documentation and Schedules (choice of risk allocation)
  • Employer, the Employer’s Representative and the Contractor incl. safety. Subcontractors and Specialists
  • Power of the Employer’s Representative and procedures to issue instruction – directions and Change Orders
  • Programme and the way the contract controls time.
  • Other Compensation Events and Delay Events
  • Defects
  • Insurance, Bonds, Guarantees and Collateral Warranties
  • Payment procedures
  • Completion, Extending time, damages
  • Resolving disagreements and disputes

 

Speaker:  E C Ryan MSc PhD C Eng MICE FCIArb

Eddie Ryan operates as a consultant on contractual issues, regularly acting as adjudicator and conciliator. He spent 18 years with a large contracting company in mainline management up to position of divisional director on a variety of major construction works.  He has recently acted as an examiner for Paper 2and 3 of the ICE Civil Engineering Law and Contract Procedure Examination over a twelve year period. He was the Director of Postgraduate Studies for Civil Engineering at Kingston University and has completed a PhD in the field of Construction Law at Kings College London.
