Many different firms participate on any construction project. All these firms are joined by contracts. The Law of Contract makes co-ordination of the construction activities possible.
Standard forms of construction contract have been used for many years. It is these contracts that define the responsibility of the contractor to construct and the client to pay. These obligation need to be understood to avoid disagreement. The obligations and powers of the client’s agent – the Engineer or Employer’s Representative and the Contractor need clear definition.
The standard forms of contract set up a framework for the administration of the contract. This course looks at both the IEI Conditions of Contract 3th Edition and the new Public Works Contracts. Contractual solutions will be dominant on the course but practical, non adversarial solutions will be discussed in the context of good practice.
Course Outline:
The course covers these aspects and in addition gives the confidence to:
· discussion on the basic law of contract/contract execution
· define the roles of the parties and the documentation
· critically analyse the contract between client and contractor
· offer solutions to the contractual problems
· offer solutions that will avoid contractual problems
· administer the construction contract either as engineer or contractor
Who should attend?
All those involved in the execution of construction work and who need their commercial awareness raising. Both contractor’s staff and staff of the engineer who are/or about to work on site.
Speaker: E C Ryan MSc PhD C Eng MICE FCIArb
Eddie Ryan operates as a consultant on contractual issues, regularly acting as adjudicator and conciliator. He spent 18 years with a large contracting company in mainline management up to position of divisional director on a variety of major construction works. He has recently acted as an examiner for Paper 2and 3 of the ICE Civil Engineering Law and Contract Procedure Examination over a twelve year period. He was the Director of Postgraduate Studies for Civil Engineering at Kingston University and has completed a PhD in the field of Construction Law at Kings College London.
